Terms of service

These terms are an agreement between you and Lucalvry LLC ("Jotmonk", "we", "us"), which provides Jotmonk™. They cover the website, the waitlist and the Jotmonk app (together, "the service").

By using the service you accept these terms and our Jotmonk privacy policy. If you use Jotmonk for a school or business, you accept these terms on its behalf and confirm you can do so.

• Tutor: the person who holds a Jotmonk account and teaches.
• Student: the person the tutor teaches, and their parent or guardian when the student is under 18.
• Lesson content: lesson audio, transcripts, notes, tasks, student records and anything else the tutor adds.
• Lesson: one recorded or uploaded session processed into notes.

Jotmonk helps tutors record or upload lessons and turn them into notes, tasks, progress views and reports for the tutor and student.

We improve the service over time. We may add, change or remove features, and we will tell tutors in advance about changes that reduce what a paid plan includes.

• You must be at least 18 to create a tutor account.
• You must not be barred from using the service under the laws that apply to you.
• Students under 18 receive notes through a parent or guardian on record.

• Give accurate information and keep it up to date.
• Keep your sign-in details safe. You are responsible for activity on your account.
• Tell us straight away at support@jotmonk.xyz if you suspect unauthorized access.
• One account is for one tutor. Do not share it.

• You record a lesson only with the student's consent, and a parent or guardian's consent for students under 18.
• You follow the recording and privacy laws of your country and your student's country, and the rules of any platform you teach on.
• You stop recording if a student or guardian withdraws their agreement, and delete the lesson if they ask.
• You review notes before sharing them. You decide what your student sees.

Notes are drafts written with the help of AI. They can contain mistakes or miss things. Each line can show the part of the lesson it came from so you can check it.

Jotmonk is a tool for record keeping. It does not give educational, medical, legal or professional advice, and it does not replace the tutor's judgment.

Your lesson content belongs to you. You give us a limited license to store, process and display it only to provide the service to you and your students, and to keep it secure.

We do not use your lesson content for advertising, and we do not use it to train third-party AI models.

You can download your data or delete your account at any time from the app.

You must not:

• Record anyone without their agreement, or record anything other than lessons you teach.
• Upload unlawful, harmful, abusive or infringing content.
• Try to break, overload, probe or reverse engineer the service.
• Scrape the service or access it by automated means we have not approved.
• Resell, sublicense or share access without our written agreement.
• Use the service to build a competing product.

Jotmonk is independent. It is not part of, endorsed by or affiliated with Preply, italki, Cambly or any other tutoring platform. Those platforms' own terms still apply to the lessons you teach there.

Current plans and prices are on the Jotmonk pricing page. When you buy a plan:

• Plans are billed monthly in advance, in US dollars, plus any tax that applies where you live.
• Your plan renews automatically each month until you cancel. You can cancel at any time, and the cancellation takes effect at the end of the period you have paid for.
• Each plan includes the number of lessons a month shown on the pricing page. You can change plans at any time; the new plan applies from your next billing period.
• The price, taxes and billing terms are shown before you agree to pay. If we change a price, we tell you before it applies to your next renewal.

Payments are non-refundable except where the law requires a refund or where a refund is stated at checkout. Nothing in these terms limits your mandatory consumer rights. Questions about a payment should be sent to support@jotmonk.xyz.

The service, its software, design, the Jotmonk™ name and logo belong to Lucalvry LLC. These terms give you the right to use the service, not to copy or reuse any part of it. If you send us feedback, we may use it without obligation to you.

We work to keep Jotmonk running, but we cannot promise it will always be available or without errors. We may pause the service for maintenance or security, and will give notice when we can.

• You can stop using Jotmonk and delete your account at any time.
• We may suspend or close an account that breaks these terms or puts others at risk, and will tell you why unless the law prevents it.
• After closing, we delete your data as described in the privacy policy. Sections that by their nature should survive, such as liability and governing law, continue to apply.

To the extent the law allows, the service is provided "as is" and "as available", without warranties of any kind, including fitness for a particular purpose and accuracy of notes.

To the extent the law allows, Lucalvry LLC is not liable for indirect, incidental or consequential losses, or for lost profits, data or goodwill. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or 100 US dollars. Nothing in these terms limits rights you have under consumer law that cannot be excluded.

You agree to cover Lucalvry LLC against claims arising from lesson content you record or upload, or from your breach of these terms or the law, including recording laws.

These terms are governed by the laws of Wyoming, United States, without regard to conflict-of-law rules. Before going to court, we both agree to try to settle any dispute informally by writing to each other. If you are a consumer, you keep the protection of the mandatory laws of the country where you live.

We may update these terms. We will post the new version on this page with a new date, and tell tutors by email at least 14 days before significant changes take effect. Continuing to use the service after that means you accept them.

These terms are the whole agreement between us about the service. If one part is invalid, the rest still applies. Choosing not to use a right does not waive it. You may not transfer these terms without our agreement; we may transfer them as part of a merger or sale.
